REGULATIONSREGARDINGLICENSINGPROCEDURESFORTELECOMMUNICATIONS

TheBoardof theCommunicationsRegulatoryAuthorityofNamibia,havingreconsidered the “RegulationsRegardingLicensingProceduresfor Telecommunications andBroadcastingService Licences and SpectrumUse Licences”published in Government Gazette 4737,No.170of 2011, dated 17June 2011,hereby publishes these”Regulations Regarding Licensing Procedures for Telecommunications andBroadcastingServiceLicences andSpectrumUseLicences”in terms of sections40,85and101,readwithsection129of theCommunicationsAct,No.8of2009,effective retrospectivelyfromthe date theAct comesintooperation asdeterminedbytheMinisterin terms of section 136(1) of theAct.

Definitions

  1. In these regulations, any word or expression to which a meaning is assigned in the Act,shall have thesamemeaningand-

“Act”means theCommunicationsAct No.8of 2009.

Submissionof documentsto theAuthority

  1. In these regulations“submit in writing to theAuthority”means either physically or electronically-

Applicability

  1. These regulations are applicable to -

ClassTelecommunicationsService licence applications

  1. (1)A person intending to provide a class telecommunications service must submit,inwritingtotheAuthority,an applicationfora class telecommunicationsservicelicencein theformmadeavailablebytheAuthority.

BroadcastingService licence applications

  1. (1) Anypersonintendingtoprovide abroadcastingservice as contemplated in theActandRegulationsSettingoutBroadcasting and TelecommunicationsServiceLicence Categories,must submit,inwritingtotheAuthority,anapplicationforabroadcasting servicelicence in theformmadeavailableby theAuthority.

Spectrum use licence applications

  1. (1) Any person intending to use spectrum,where the Authority,in its sole discretion,determinesthatspectrum uselicence applicationswillbeprocessed onafirstcome,first servedbasis,must submit,inwriting to theAuthority,anapplicationfora spectrum use licence n the formmadeavailable by theAuthority.

Transfer of licencesand transfer ofcontrol of licences

Amendment of licences

  1. (1) A licensee mayrequest the Authority to amend its licence by submitting inwriting totheAuthority,anapplication to amenda licencein theformmadeavailablebythe Authority.

Renewal of licences

  1. (1) A licensee may request the Authority to renew its licence by submitting inwriting totheAuthority,anapplication torenewa licenceintheformmade availableby the Authority.

Withdrawal of licences

  1. (1) Ifa licenseecannotprovideservicein accordancewithits licenceforaperiod greater than twenty-four (24) hours,it must notify the Authority of that occurrence within twenty- four(24) hours of the occurrence,or if the licensee was unaware of the interruption of service,as soon asthelicenseebecomesawareoftheoccurrence.

Application procedures

  1. (1) Inrespect of any application madeintermsof theseregulations,except applications concerning spectrum used in conjunction with thefollowing telecommunications servicesthatmaybeprovidedwithoutalicence:amateur service,aeronautical service,maritime service,navigation andradarsystem service,theAuthoritywill publish a noticeof the applicationin theGovernmentGazette.

Application procedures concerning spectrum used in conjunction with licence exempt telecommunicationsservices

  1. (1) In respect of any application concerning spectrum used in conjunction withthefollowingtelecommunications servicesthatmaybeprovidedwithouta licence:amateur service,aeronauticalservice,maritimeservice,navigationandradarsystemservice,theAuthority maypublish a noticeof the applicationin the Government Gazetteandfollow theproceduresetout in regulation11 above,or it mayfollow the procedures set out in this regulation12.

Licence modification procedures

  1. (1)The Authority may initiate a licence modification proceeding contemplated thegroundsfor such modification.

Oral hearings

  1. (1) If the Authority considers it necessary or appropriate, it will also hear oralsubmissionsinrespectofanyapplicationmadeintermsoftheseregulationsor anylicence modification proceeding.

Confidential information

terms of section29of theAct,and thenotice of theclosedmeetingrequiredbysection29(4)must be maintainedintherelevantapplicationfile.

Publication of licensingdecisions and licences

  1. (1)All decisions made in terms of these regulations will be communicated to the applicants and otherrelevant parties inwriting togetherwithreasons,andmaybepublished in the GovernmentGazette.

Reconsideration

  1. (1) The Authority may, on its own, reconsider any decision made in terms of theseregulationswithin thetimeset out insection31of theAct. (2)Any person may submit to the Authority in writing a request to reconsider any decisionmadein terms of these regulationswithin thirty(30) days of notice of the decision,and the Authoritywillreconsidersuchregulationwithin the time set out insection31 of theAct.

Repeal of Regulations

  1. The RegulationsRegardingLicensingProceduresforTelecommunications and BroadcastingServiceLicences andSpectrumUse Licencespublished in Government Gazette 4737, No.170 of 2011,dated 17June 2011,are hereby repealed.
