REGULATIONSREGARDINGLICENSINGPROCEDURESFORTELECOMMUNICATIONS

TheBoardof theCommunicationsRegulatoryAuthorityofNamibia,havingreconsidered the “RegulationsRegardingLicensingProceduresfor Telecommunications andBroadcastingService Licences and SpectrumUse Licences”published in Government Gazette 4737,No.170of 2011, dated 17June 2011,hereby publishes these”Regulations Regarding Licensing Procedures for Telecommunications andBroadcastingServiceLicences andSpectrumUseLicences”in terms of sections40,85and101,readwithsection129of theCommunicationsAct,No.8of2009,effective retrospectivelyfromthe date theAct comesintooperation asdeterminedbytheMinisterin terms of section 136(1) of theAct.

Definitions

In these regulations, any word or expression to which a meaning is assigned in the Act,shall have thesamemeaningand-

“Act”means theCommunicationsAct No.8of 2009.

COMMUNICATIONSREGULATORYAUTHORITYOFNAMIBIA

Submissionof documentsto theAuthority

In these regulations“submit in writing to theAuthority”means either physically or electronically-

(1） by hand to the head offices of the Authority,namely CommunicationHouse,56 Robert MugabeAvenue,Windhoek orat any other addressset outby theAuthorityfrom timetotime;
(2) by post to thehead officesof theAuthority,namelyPrivateBag13309,Windhoek 9000or at anyother addresssetoutby theAuthorityfromtimetotime;
(3)by electronic mail to the following address: cran@cran.na or at any other address setoutbytheAuthorityfromtimetotime;
(4） byfacsimile to thefollowingfacsimilenumber:+26461238646or at any other numbersetoutbytheAuthorityfromtimetotime;or
(5) inanyothermanneror at alternative addressessetoutbytheAuthorityfromtimeto time.

Applicability

These regulations are applicable to -

(1) Class telecommunications service licence applications;
(2) Broadcasting service licence applications;
(3) Spectrum use licence applications,where the Authority,in its sole discretion, determinesthatspectrum uselicence applicationswill be processed ona firstcome,firstserved basis;
(4) Licence transfer applications(fortelecommunications service,broadcastingservice and spectrum use);
(5) Licence amendment applications (for telecommunications service, broadcasting serviceandspectrumuse);
(6) Licence renewal applications(for telecommunications service,broadcastingservice and spectrum use);and
(7) Withdrawal of licences by licensees(for telecommunicationsservice,broadcasting service andspectrum use).

ClassTelecommunicationsService licence applications

(1)A person intending to provide a class telecommunications service must submit,inwritingtotheAuthority,an applicationfora class telecommunicationsservicelicencein theformmadeavailablebytheAuthority.

(2) The application must -
(a) set out thefull andofficialnameof theperson intending toprovideaclass telecommunicationsservice(applicant),andif anaturalperson,theidentitynumber of that person,and if a juristic person,the registration number of that person;
(b) set out the name of the contactperson(if different fromthe applicant) and the following contact details -
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimile numbers(s); and
(v) electronic mail address(es);
(c) setoutfull details ofall ownershipinterests inthe applicant,includingtheidentity andnationalityofholdersofownershipinterests andif theholdersofownership interests are juristic persons,full details of all their ownership interests;
(d) set out full detailsregardingforeign ownershipinterests in the applicant;
(e) identifythecategoryofclasstelecommunicationsservicelicence ascontemplated in the RegulationsSettingoutBroadcasting and TelecommunicationsServiceLicence Categories;
(f) setoutacomplete,accurateandconcisestatementofthetelecommunicationsservices intended tobe provided,including a description and diagram of anynetwork tobe operated,constructedorused;and
(g) includeanyotherinformationthe applicantbelievesmightberelevanttothe Authority in considering the application.
(3) The class telecommunications service licence applicationmust be accompanied by the relevant application fee as determined by the Authority from time to time.
(4) Theclass telecommunicationsservicelicence applicationmustbe accompanied by a spectrum use licence applicationif the applicant intends to use spectrum in theprovisionof the telecommunicationsservice.
TheAuthoritymayrequest further information or documentation,which must be provided to theAuthorityin thetime and themanner set outby theAuthority.

BroadcastingService licence applications

(1） Anypersonintendingtoprovide abroadcastingservice as contemplated in theActandRegulationsSettingoutBroadcasting and TelecommunicationsServiceLicence Categories,must submit,inwritingtotheAuthority,anapplicationforabroadcasting servicelicence in theformmadeavailableby theAuthority.

(2) The application must -
(a) set out the full and official name of the person intending to provide a broadcasting service(applicant),and ifanaturalperson,theidentitynumberof thatperson,andif a juristic person,the registration number of that person;
(b) set out the name of the contact person(if different from the applicant)and the following contact details-
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimilenumbers(s);and
(v) electronic mail address(es);
(C) set outfull detailsof allownershipinterestsinthe applicant,includingtheidentity andnationalityofholders ofownershipinterests and if theholders ofownership interests are juristic persons,full details of all their ownershipinterests;
(d) set outfull detailsregardingforeign ownershipinterestsin the applicant;
(e) if the applicant is a juristic person,set out full names,nationalities and identity numbersof themembersof theBoard of Directors or othergoverningbody;
(f) identify the category of broadcasting service licence as contemplated in the RegulationsSetting outBroadcasting andTelecommunications ServiceLicence Categories;
(g) in respectof the commercial,community,and public broadcasting servicecategories, indicatewhetherthe applicantintendstoprovideitsown signaldistributionservice orwhetheritintendstocontractwith asignaldistributionservicelicenseeforsuch service;
(h) inrespectof thecommercial,community,andpublicbroadcastingservicecategories, indicatewhether the applicant intendstousespectrumintheprovisionof the broadcasting service;
(i) setoutacomplete,accurate andconcisestatementof thebroadcastingservices intended to be provided;
(i) inrespectofcommercial,community,andpublicbroadcastingservicecategories,set outaproposedprogrammescheduledetailingthe daily transmissiontimeallocated todifferentprogrammetypes;
(k) includea statement of accounts settingout thefinancial resources availableto the applicant in relation to the broadcasting service licence applied for;
(I) includeaconcisestatementofexpertise andexperienceoftheapplicant;
(u) indicatefulldetailsof any ownershipinterests heldinexistingbroadcastingservices licences andotherbroadcastingservices licence applications,bythe applicant and if the applicant is a juristic persons,by persons who hold ownership interests in the applicant;and
(n) include anyother information the applicantbelievesmightberelevant tothe Authorityinconsideringtheapplication.
(3) Thebroadcastingservice licence applicationmust be accompanied by therelevant applicationfee asdeterminedbytheAuthorityfrom time totime.
(4) In respectofcommercial,community,andpublicbroadcastingservicecategories,the broadcastingservicelicence applicationmustbe accompaniedbya spectrumuselicence application if the applicant intends to usespectrum in theprovision of thebroadcastingservice.
(5) Inrespect of commercial,community,andpublicbroadcastingservicecategories, thebroadcastingservicelicence applicationmustbe accompaniedbyasignal distributionlicence application if the applicant intends to provide its own signal distribution service and the applicant is not alreadyasignaldistributionservicelicensee.
(6) TheAuthority mayrequestfurtherinformation or documentation,whichmust be provided to the Authority in the time and the manner set out by the Authority.

Spectrum use licence applications

(1) Any person intending to use spectrum,where the Authority,in its sole discretion,determinesthatspectrum uselicence applicationswillbeprocessed onafirstcome,first servedbasis,must submit,inwriting to theAuthority,anapplicationfora spectrum use licence n the formmadeavailable by theAuthority.

(2) The application must -
(a) set out the full and official name of the person intending to use spectrum (applicant), and if a natural person,the identity number of that person,and if a juristic person, the registration number of that person;
(b) set out the nameof the contact person(if differentfrom the applicant) and the following contact details-
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimile numbers(s);and
(v) electronic mail address(es);
(c) set outfull details of all ownershipinterests in the applicant,includingtheidentity andnationalityofholdersofownershipinterestsandif theholdersofownership interests are juristic persons,full details of all their ownershipinterests;
(d) applied for;
(e) setoutacomplete,accurateandconcisestatementoftheservicesintendedtobe provided using the spectrum being applied for;
(f) include thecompleted technicalportionof the applicationformmade availableby theAuthority;and
(g) include anyotherinformation theapplicantbelievesmightberelevant to the Authorityin consideringthe application.
(3) The spectrum use licence applicationmust beaccompaniedby the relevant applicationfee asdeterminedby theAuthorityfrom time to time.
（4) TheAuthority mayrequestfurther information or documentation,whichmust be provided to theAuthority in the time and themanner set out by the Authority.

Transfer of licencesand transfer ofcontrol of licences

7.(1)A licensee may request the Authority to authorise the transfer of its licence or the transferofcontrol ofitslicencebysubmittinginwritingtotheAuthority,an application to transfer a licence or transfer control of a licence,intheformmade available by theAuthority.
(2) Name changes and transfersofownershipinterestsnotresultingina transferof control donotrequirepriorapprovalfromtheAuthority,howevertheAuthoritymustbenotifiedof theimpending change at leastfourteen(14) daysprior to theeffective date.
(3) The application must -
(a) set out details of the licence,including thelicencenumberandinclude a copy of the licence;
(b) setout full details of the licensee,including thefull and official name of the licensee, and if a natural person,theidentity number of that person,and if a juristic person, the registration number of that person;
(c) set out the name of the contactperson(if different from the licensee)and the following contact details-
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimile numbers(s);and
(v) electronic mail address(es);
(d) inrespectoftelecommunicationsservicelicences,setout thedetailsof theproposed new licensee,called for in sections 4(2) (a)-(d) and (g) of these regulations;
(e) inrespect of broadcasting service licences,set out the details of the proposednew licensee,called for in sections 5 (2)(a)-(e)and 5(2)(k)-(n) of these regulations;
(f) inrespect of spectrum use licences,set out the details of theproposednewlicensee called for in sections 6 (2) (a) -(c) and (g) of these regulations;
(g) set out a complete,accurate andconcisestatement of thereasonsfor theproposed transferortransferofcontrol;and
(h) include anyother informationthe applicantbelievesmightberelevanttothe Authorityinconsideringthe application.
(4) Thetransfer applicationmustbe accompaniedbytherelevantapplicationfee as determinedbytheAuthorityfromtimetotime.
(5) Ifany amendment to the licence is sought,thelicence transfer applicationmust be accompanied bya licenceamendment application.
(6) TheAuthoritymayrequestfurtherinformation or documentation,whichmust be provided to the Authority in the time and the manner set out by the Authority.

Amendment of licences

(1) A licensee mayrequest the Authority to amend its licence by submitting inwriting totheAuthority,anapplication to amenda licencein theformmadeavailablebythe Authority.

(2) Changestothelicensee’sname andnameanddetailsofcontactpersonsdonot require prior approval from theAuthority,but theAuthority must be notified of the impending change atleastfourteen(14)dayspriortotheeffectivedate.
(3) The application must -
(a) set out details of the licence,including the licence number and include a copy of the licence;
(b) set outfulldetails of thelicensee,including thefull and official name of the licensee, and if a natural person,the identity number of that person,and if a juristic person, theregistrationnumberof thatperson;
(C) set out the name of the contact person (if different from the licensee)and the following contact details -
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimile numbers(s);and
(v) electronic mail address(es);
(d) set out acomplete,accurate andconcisestatementof theproposedamendment;
(e) set out a complete,accurate andconcise statement of thereasonsfor theproposed amendment;and
(f) include anyotherinformationthe applicantbelievesmight berelevanttothe Authorityinconsideringtheapplication.
(4) The amendment application must be accompanied by the relevant applicationfee as determinedbytheAuthorityfromtimetotime.
(5) TheAuthority mayrequestfurtherinformation or documentation,whichmust be provided to theAuthority in the time and themanner set out by theAuthority.

Renewal of licences

(1) A licensee may request the Authority to renew its licence by submitting inwriting totheAuthority,anapplication torenewa licenceintheformmade availableby the Authority.

(2) The application must -
(a) set outdetailsof thelicence,including thelicencenumberandincludea copyof the licence;
(b) set outfull details of the licensee,including thefull andoffcial nameof the licensee, and if a natural person,theidentity numberof thatperson,andif a juristicperson, theregistrationnumber of thatperson;
(c) set out the name of the contact person(if different from the licensee)and the followingcontact details-
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimile numbers(s);and
(v) electronic mail address(es);
(d) set out a complete and accurate statement detailing any action taken by the Authority or other entitywithcompetent jurisdictioninrelationto anybreachorallegedbreach by the licensee of theAct,regulations or the licensee’s licence;and
(e) include anyother informationthe applicantbelievesmightberelevantto the Authorityin consideringthe application.
(3) The amendment applicationmust be accompanied by the relevant applicationfee as determinedbytheAuthorityfromtimetotime.
(4) The Authority mayrequestfurther information or documentation,which must be provided to the Authority in the time and the manner set out by the Authority.

Withdrawal of licences

(1) Ifa licenseecannotprovideservicein accordancewithits licenceforaperiod greater than twenty-four (24) hours,it must notify the Authority of that occurrence within twenty- four(24) hours of the occurrence,or if the licensee was unaware of the interruption of service,as soon asthelicenseebecomesawareoftheoccurrence.

(2) If a licenseeintends topermanentlydiscontinueprovidingservicein accordance with its licence,it must request theAuthority towithdrawits licence by submitting inwriting to the Authority,an application to withdraw a licence in the form made available by the Authority.
(3) The application must -
(a) set outfull details of the licence,including thelicence numberand include acopy of the licence;
(b) set out full details of the licensee,including thefull and official name of the licensee, and if a natural person,the identity number of that person, and if a juristic person, the registrationnumber of that person;
(c) setoutthenameofthecontactperson(ifdifferentfromthelicensee)andthe following contact details -
(i) physical address;
(i) postal address;
(ii) telephone number(s);
(iv) facsimilenumbers(s);and
(v) electronicmail address(es);
(d) set outa complete,accurate andconcisestatement of thereasonsfortheproposed withdrawal;
(e) setout thedate thelicenseeintendstopermanentlydiscontinueprovidingservice, whichmustbe at least sixty(60) days after the date the applicationis submitted;
(f) indicatewhether thelicenseehaspaid allfeespayabletotheAuthorityinrelationto the licence;and
(g) include anyother informationthe applicantbelievesmightberelevanttothe Authorityinconsideringtheapplication.
(4) The Authority may request further information or documentation,which must be provided to the Authority in the time and the manner set out by the Authority.

Application procedures

(1) Inrespect of any application madeintermsof theseregulations,except applications concerning spectrum used in conjunction with thefollowing telecommunications servicesthatmaybeprovidedwithoutalicence:amateur service,aeronautical service,maritime service,navigation andradarsystem service,theAuthoritywill publish a noticeof the applicationin theGovernmentGazette.

After theAuthoritypublishesnoticeof an applicationin theGovernment Gazette, the publicmay submit in writing to the Authority,commentswithin the time set out in thenotice, which time may not be less thanfourteen(14) daysfrom the date ofpublication.
(3) If theAuthorityconsiders it necessary,it will provide the opportunity to the applicant torespondtopubliccomments.
(4) Applicantresponsestopubliccommentsmustbe submittedinwriting tothe Authoritywithin thetimesetoutbytheAuthority,whichtimemaybenotless thanfourteen(14) daysfrom the submission ofpublic comments orif the opportunityfor thesubmission ofresponses ispublishedinasubsequent Government Gazette,not less thanfourteen(14)daysfrom thedate of publication.
(5) The timesfor the submission ofpubliccommentsand applicant responses are tobe determinedbytheAuthorityinlight ofthenatureofthe application.
(6) TheAuthoritymay consider written submissionsnot timeously filed if,in its opinion, it is practicable to do so.
(7)The Authority may request further written submissions,for example,further informationorclarification,whichmustbeprovidedtotheAuthorityinthetime andthemannerset outbytheAuthority.
(8) Allwrittensubmissionsmust-
(a) contain thenameandcontactdetailsof thepersonmakingthewrittensubmissions andthenameandcontactdetailsofthepersonforwhomthewrittensubmissionis made,if different;
(b) beclear andconcise;and
(c) conformto anyfurtherrequirementsdeterminedbytheAuthorityfromtimetotime.
Afterconsideringany applicationmadeinterms of theseregulations and anywritten and oral submissions,theAuthoritywill either deny the application or grant the application,inwhole or in part, and —
(a) issue the appropriate licenceinrespect of class telecommunicationsservice licence applications,broadcasting services licence applications and spectrum use licence applications;
(b) issue the appropriate licence to the transferee in respect of licence transfer applications;
(c) issue an amended licence inrespect of licence amendment applications;or
(d) issuearenewal licenceinrespect oflicencerenewal applications.
(10)In the event the Authority is unable to render a decision within sixty (60) days of thelastwritten ororal submission,theAuthoritywill informthe applicant or licenseeofits inability and thereasonsfor suchinability andwhat measures arebeing takento address thematter urgently, which matter must thenbe addressedwithin afurther maximumperiod of sixty(60) days,unless the Authorityhasidentifiedextraordinary circumstances,beyonditsreasonable control thatmakesit impossibletorenderits decisionwithin thefurthermaximumperiod of sixty(60)days.

Application procedures concerning spectrum used in conjunction with licence exempt telecommunicationsservices

(1) In respect of any application concerning spectrum used in conjunction withthefollowingtelecommunications servicesthatmaybeprovidedwithouta licence:amateur service,aeronauticalservice,maritimeservice,navigationandradarsystemservice,theAuthority maypublish a noticeof the applicationin the Government Gazetteandfollow theproceduresetout in regulation11 above,or it mayfollow the procedures set out in this regulation12.

(2） After considering any applicationmadein terms of thisregulation and anyfurther informationsubmittedby the applicant,theAuthoritywill either denytheapplicationorgrant the application,inwholeorinpart,and-
(a) issue the appropriate licenceinrespect ofclasstelecommunications servicelicence applications,broadcasting serviceslicence applications and spectrum uselicence applications;
(b) issue the appropriatelicence to the transferee inrespectof licence transfer applications;
(C) issue an amended licence inrespect of licence amendment applications;or
(d) issuearenewal licenceinrespectof licencerenewalapplications.
(3)In the event the Authority is unable to render a decision within thirty (30) days of thelastwrittenor oralsubmission,theAuthoritywillinformtheapplicantorlicenseeofitsinability and thereasonsfor suchinability andwhatmeasures arebeing taken to address thematterurgently, whichmattermustthenbeaddressedwithinafurthermaximumperiodoffourteen(14)days,unless theAuthorityhasidentifiedextraordinary circumstances,beyond itsreasonable control that makesit impossible torenderits decisionwithin thefurthermaximum period offourteen(14) days.

Licence modification procedures

(1)The Authority may initiate a licence modification proceeding contemplated thegroundsfor such modification.

(2)The licensee may submit in writing to the Authority, comments within the time set out in the notice,which time may not be less than thirty (30) days from the date of notice.
(3)Thereafter, the Authority will publish a notice,either as originally proposed or as modified takingintoaccount thelicensee’scomments,ofaproposed licencemodificationinthe GovernmentGazette.
(4)After the Authoritypublishes the notice of a proposed licence modification in the Government Gazette,thepublicmaysubmitinwritingtotheAuthority,commentswithinthetime set out in thenotice,which time may not be less than thirty(30) days from the date of publication.
(5) If theAuthorityconsidersit necessary,itwill provide the opportunity tothelicensee torespondtopubliccomments.
(6) Licensee responses topublic commentsmust besubmitted inwriting to theAuthority withinthetimesetoutbytheAuthority,whichtimemaybenotlessthanfourteen(14) daysfromthe submissionofpubliccommentsoriftheopportunityforthesubmissionofresponsesispublishedin a subsequent Government Gazette,not less thanfourteen(14) daysfrom the dateof publication.
(7)The times for the submission of public comments and licensee responses are to be determinedby theAuthorityinlightof thenatureof theapplication.
(8)TheAuthority may consider written submissions not timeously filed if,in its opinion, it is practicable to do so.
(9)The Authority may request further written submissions,for example,further informationorclarification,whichmustbeprovided totheAuthorityinthetime andthemannerset out by the Authority.
(10) All written submissions must -
(a) containthenameandcontactdetailsofthepersonmakingthewrittensubmissions and thename andcontactdetailsof thepersonforwhom thewrittensubmissionis made,if different;
(b) be clear and concise;and
(c) conformtoanyfurtherrequirementsdeterminedbytheAuthorityfromtimetotime.
(11)After considering anywritten and oral submissionsin respect of aproposed licence modification,theAuthoritymusteitherissueamodifiedlicenceordecidenottoissuethemodified licence.
(12)In the event the Authority is unable to render a decision within sixty(60) days of thelastwrittenororalsubmission,theAuthoritywillinformtheapplicantorlicenseeofitsinability and thereasonsforsuch inability andwhatmeasures arebeing taken to address thematter urgently, which matter must thenbe addressedwithina further maximum period of sixty(60) days,unless the Authorityhasidentified extraordinary circumstances,beyond itsreasonable control thatmakes it impossible to renderits decisionwithin thefurthermaximum period of sixty(60) days.

Oral hearings

(1) If the Authority considers it necessary or appropriate, it will also hear oralsubmissionsinrespectofanyapplicationmadeintermsoftheseregulationsor anylicence modification proceeding.

(2) TheAuthority must invite the public tomake oral submissions at leastfourteen(14) days prior to the hearing.
(3) Unless otherwise specifiedby theAuthority,hearingswill be open to thepublic.
(4) The format and agenda of the hearing is at the discretion of theAuthority,depending on thenature of theproceeding,provided however,that thehearing should be informal innature.
(5) All oralsubmissionsmust-
(a) include astatementindicatingthename andcontact details of thepersonmakingthe oralsubmissionandthenameandcontactdetailsofthepersonforwhomtheoral submission ismade,if different;
(b) be clear and concise;and
(c) conformtoanyfurtherrequirementsdeterminedbytheAuthorityfromtimetotime.
(6) If theAuthorityconsiders it necessary,it will provide the opportunity to the licensee orapplicanttorespondtooralsubmissions.
TheAuthoritymayrequestfurtheroral orwrittensubmissions,forexample,further informationorclarification,whichmustbeprovidedtotheAuthorityinthetime andthemannerset out by theAuthority.
(8) At theconclusionof thehearing,a concisereport summarising theoral submissions must beprepared and placed in therelevant applicationfile by theAuthority.

Confidential information

15.(1)Any person providing information or documentation may designate informationasconfidential,provided,however,iftheAuthorityisoftheopinionthat theinformation isnotconfidential,itmustinformthepersonthatitmaywithdrawtheinformation,agreethatitwill not betreated asconfidential,orrequest a hearing on theissueofconfidentialitytobe conducted in termsofsection28oftheAct.
(2)Any person making oral submissions may request a closed hearing on the grounds that the submissions are confidential. Closed hearingswill be treated as confidentialmeetings in

terms of section29of theAct,and thenotice of theclosedmeetingrequiredbysection29(4)must be maintainedintherelevantapplicationfile.

Condonation

16.(1) In the event any party is unable to comply with any time set out in these regulations,it may request from the Authority an extension of time at least seven(7) daysprior to the timeset out orwithin suchother timeperiodagreedbytheAuthorityupongoodcauseshown.
(2） TheAuthoritywillrespondtotherequestforcondonationassoonaspracticable,and mayeithergrant ordeny therequest,nits sole discretion,based on,amongother things,thenature of theproceedingand the reasonsfor non-compliancewith the timeset out.

Ex parte communications

17.A person may not communicate with the members of the Board,the CEO or staff members of,orconsultants to theAuthority,to discuss the subjectmatterof an applicationproceeding, except asprovidedfor herein.

Record of proceedings

18.(1) )AlldocumentsdeemedrelevantbytheAuthoritytotheapplication proceedings contemplated by theseregulations,including information and documentation provided in terms of theseregulations anddecisionsmadebytheAuthority,must bemaintained bytheAuthority separatelyforeach applicationinfiles located at thehead offices of theAuthority and,if practicable, ontheAuthority’swebsite.
(2) Exceptfor confidentialinformation,anypersonmay examine the application proceeding files either at the head offices of the Authority during normal business hours and copies maybe made onpayment of afee determined by the Authority from time to time,and,if available, on theAuthority’swebsitewhere copiesmaybedownloaded free ofcharge.

Publication of licensingdecisions and licences

(1)All decisions made in terms of these regulations will be communicated to the applicants and otherrelevant parties inwriting togetherwithreasons,andmaybepublished in the GovernmentGazette.

(2) TheAuthority’sregister of licencesmaintainedin terms ofsection27(3)of theAct and copies of all licences,will be held at the head offices of the Authority and if practicable,on the Authority’s website. (3)Anypersonmay examine the register of licences and copies of licences either at the head offices of theAuthority duringnormal business hours andcopiesmaybemade onpayment of afeedeterminedbytheAuthority,and,if available,ontheAuthority’swebsitewherecopiesmaybe downloadedfreeofcharge.

Reconsideration

(1) The Authority may, on its own, reconsider any decision made in terms of theseregulationswithin thetimeset out insection31of theAct. (2)Any person may submit to the Authority in writing a request to reconsider any decisionmadein terms of these regulationswithin thirty(30) days of notice of the decision,and the Authoritywillreconsidersuchregulationwithin the time set out insection31 of theAct.

(3) The Authoritymaypublishits decision onreconsideration without further submissions being received,orit may provide an opportunityforfurthersubmissionsin amannerset out by the Authority.

Repeal of Regulations

The RegulationsRegardingLicensingProceduresforTelecommunications and BroadcastingServiceLicences andSpectrumUse Licencespublished in Government Gazette 4737, No.170 of 2011,dated 17June 2011,are hereby repealed.
