REGULATIONSREGARDINGTHESUBMISSIONOF INTERCONNECTIONAGREEMENTSANDTARIFFS

TheBoardoftheCommunicationsRegulatoryAuthorityofNamibia,intermsofsections49and 53,read with section129 of the CommunicationsAct,2009(Act No.8 of 2009),publishes these “RegulationsRegarding the Submission of InterconnectionAgreements and Tariffs”,effective from thedatetheActcomesintooperationasdeterminedby theMinisterintermsofsection136(1)of the Act.

Definitions

  1. In these regulations,any word or expression to which a meaning is assigned in the Act, shall have the same meaning and -
  2. “Act”means the Communications Act,2009(Act No.8of 2009);
  3. “DomesticInterconnectionAgreement”meansaninterconnectionagreement concludedbetween persons who are licensed to provide services in Namibia or who are providing services in Namibia thatmaybeprovidedwithoutalicence;and
  4. “International InterconnectionAgreement”means aninterconnection agreement concluded between a personwhois licensed toprovide services inNamibia orwhoisproviding servicesinNamibia thatmaybeprovidedwithout a licence,anda person authorised toprovideservicesin ajurisdiction outsideofNamibia.

  1. (1) Theseregulationsare applicable to thesubmission ofinterconnection agreements to theAuthority in terms of sections 49(4) and (16) of theAct.

  1. (1) If theAuthoritydeterminesthat anInternational InterconnectionAgreement has the effect of impairing competition or the interoperability of networks,the Authority must invite thelicenseeandthepublictomakeoralsubmissionsbynoticeintheGovernmentGazetteatleast fourteen(14)daysprior tothehearing.

  1. (1) After thesubmissionof a tariffortariff amendment,theAuthoritywill as soonas is practicable,publisha notice of the submissionin the Government Gazette. (2)The Authority must maintain copies of all tariffs submitted to it at the head offices oftheAuthorityandifpracticable,ontheAuthority’swebsite. (3)Any person may examine copies the tariffs and tariff amendments submitted at the head offices of the Authority during normal business hours and copies may be made on payment of a feedeterminedby theAuthority,or,if practicable,on theAuthority’swebsitewherecopiesmaybe downloadedfreeofcharge. (4)After considering the tariff or tariff amendment and anyfurtherwritteninformation or documentation, the Authority must take such action as is contemplated in sections 53(12-19) of the Act. (5)The Authority must maintain a register of approved tariffs and tariff amendments (to beknown as theregister of tariffs),and copies of all such tariffs and tariff amendments,at thehead officesoftheAuthorityandifpracticable,ontheAuthority’swebsite.

Written submissions on tariffs

  1. (1)After theAuthoritypublishes a Government Gazettenoticereferred toin regulation8(1),thepublicmaysubmit inwritingtotheAuthoritywrittencommentswithinfourteen (14) daysfrom thedate of publicationof thenotice.

Confidentialinformation

  1. (1) Anypersonsubmittingdocumentsormakingwrittensubmissionstothe Authority in terms of these regulationsmay designate information as confidential,provided,however, iftheAuthorityisoftheopinionthattheinformationisnotconfidential,itmustinformtheperson thatheorshemaywithdrawtheinformation,agreethatitwillnotbetreated asconfidential,or request a hearing on theissue of confidentiality tobe conducted in terms of section 28of theAct, provided howeverthat tariffs and interconnection agreements themselves arenot confidential.
