NOTICE FOR THE APPOINTMENT OF INSPECTORS AND A SPECIAL INVESTIGATOR IN TERMS OF SECTIONS 123 AND 124 OF THE COMMUNICATION ACT, 2009

The ICT sector continues to expand in business activities therefore, the regulation and investigation of activities by the Authority requires employees with expertise and knowledge in specialised fields such as type approval, spectrum management and postal management to conduct investigation relating thereto. The Authority further requires an expert special investigator to assess and investigate network capacity in the Telecommunication sector as the ICT industry continues to magnify.

Section 123(1) of the Act provides that the Authority may appoint any of its employees as inspectors to exercise any powers conferred upon them by the Act. The Act mandates inspectors to investigate offences as contemplated in section 127 of the Act and any activities prohibited by the Act or for purposes of doing anything permitted by the Act.

Section 124 of the Act provides that the Authority may appoint a person who has expert knowledge in a particular field to be a special investigator to investigate any contravention of a provision of the Act or any aspect thereof and that such a special investigator may be further appointed as an inspector for a specific purpose. The Act mandates the special investigator to investigate any contravention of a provision of the Act.

The Communications Regulatory Authority of Namibia, in terms of regulations 5 of the ‘Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences and Spectrum Use Licences’, in Government Gazette No. 4785, General Notice No. 272, dated 29 August 2019, herewith gives notice that the Applicant referred to in the table below, has applied for a broadcasting service licence to the Authority:

NOTICE IN TERMS OF REGULATION 7 OF THE REGULATIONS REGARDING RULE-MAKING PROCEDURE, COMMUNICATIONS ACT, 2009

The Communications Regulatory Authority of Namibia in terms of regulation 7 of the Regulations Regarding Rule-Making Procedures published under Government Gazette No. 4630, General Notice No. 334, dated 17 December 2010, herewith gives notice that it will hold a public hearing regarding:

  1. The proposed Frequency Band Plan of Namibia, as published in Government Gazette No. 7350, General Notice No. 409 dated 02 October 2020.
  2. The proposed Frequency Channeling Plan for the Spectrum Band 694-790 MHz , as published in the Government Gazette No. 7539, General Notice No. 196 dated 21 May 2021.

Members of the public are invited to make oral submissions at the aforesaid public hearing subject to the following:
