REASONSFORDECISION

MobileTelecommunicationsLimitedsubmittedanapplicationforwithdrawalofspectrumuse licencesinthe25GHzto26GHzspectrumbandinaccordancewithRegulation10of theRegulations regardingLicensingProceduresforTelecommunications andBroadcastingServiceLicences and SpectrumUseLicences aspublishedin Government GazetteNo.4785,GeneralNotice.No.272 dated29August2011(as amended)totheAuthorityon20January2014forconsideration.

These frequencies as listed in the table above wereissued on a nationalbasis allowing utilisation thereofwithin thebordersoftheRepublicofNamibia.Thereasonsfortheproposedwithdrawal wasthattheabove-captionedfrequencieswerenolongerutilisedsinceAugust2013andthatall telecommunicationsserviceshavebeenmigratedtospectrumuselicences awardedtothe18GHz spectrumband.It wasfound that networkperformancewithin the25GHzto26GHzspectrumband isnegatively affectedbyrainresultinginpoorqualityofservice.HenceMobileTelecommunications Limitedmadeabusinessdecisiontodecommissionnetworkequipmentinthe25GHzto26GHz spectrumband and migrate all customers utilising services in thisband to18GHz.This processwas concludedinAugust2013asperdocumentationsubmitted.

Following due process in terms of Regulations Regarding Licensing Procedures for TelecommunicationsandBroadcastingServiceLicences andSpectrumUseLicences,theAuthority published a noticein the Government GazetteNo.5442,NoticeNo78,dated7April 2014,allowing fourteen(14)daysforpubliccomments.Nocommentswerereceivedwithinthestated timeframe andsubsequentlynoreplycommentswererequiredfromMobileTelecommunicationsLimited.

TheAuthorityfoundtheapplicationforwithdrawalofspectrumuselicencesinthe25MHzto26MHz spectrumbands as submittedbyMobileTelecommunicationstobecompliant toRegulation10(2) ofRegulationsregardingLicensingProceduresforTelecommunications andBroadcastingService Licences andSpectrumUseLicences aspublishedinGovernment GazetteNo.4785,General Notice. No.272dated29August2011(As amended).Thisisbecause the applicationsets out thereasonsfor theproposedwithdrawal,date of discontinuation and thefees arepaidupto date.

TheAuthoritynotesthatMobileTelecommunicationsLimitedhastaken all necessarystepsto ensure continuationofservicesofferedtocustomersduetothefactthatall telecommunicationsserviceshave beenmigratedtothe18GHzspectrumbandpriortosubmittingtheapplicationforwithdrawal tothe Authority.Inlight of theabovetheAuthorityapprovesthewithdrawalof thespectrumuselicences issuedtoMobileTelecommunicationsLimitedon13September2012aspublishedinGovernment GazetteNo.5037,NoticeNo.305as listed in the table above.

The CommunicationsRegulatoryAuthority ofNamibia,in terms of sections101readwithregulations 6and 1l of theRegulations Regarding LicensingProcedures for Telecommunications and BroadcastingServiceLicencesandSpectrumUseLicences”,publishedinGovernment GazetteNo. 4785,NoticeNo.272,dated29August2011(as amended),herewithgivesnotice that the application foraspectrumuselicencesubmittedbyMobileTelecommunicationsLimitedhasbeendeniedin whole.Thefollowing arethereasonsfor thedecision:

  1. MobileTelecommunicationsLimitedsubmittedanapplicationforaspectrumuselicense fortelecommunicationsservicestotheAuthorityon17June2011forconsideration.Due process inrespect of the applicationwasfollowed in terms of the procedures outlined in theRegulationsregardingLicensingProceduresforTelecommunications andBroadcasting ServiceLicencesandSpectrumUseLicences.

  2. Itshouldbenotedthattheapplicationhereinwassubmittedpriortothecompletionofthe transitioningprocess oftelecommunicationsserviceandspectrumuselicences aspublished in GovernmentGazetteNo.4946,GeneralNoticeNo.121dated20March2012for telecommunicationsservicelicences andGovernmentGazetteNo.5037,NoticeNo.305 dated13September2012forspectrumuselicencesrespectivelyintermsof section135of the CommunicationsAct(No.8of2009)(hereinafterreferred toas”theAct”)

  3. MobileTelecommunications Limitedwasissuedwith aClass Comprehensive TelecommunicationsServiceLicense(ECS&ECNS)by theAuthorityin termsofsection 38of theActandtheRegulationsregardingTransitionalProceduresforTelecommunications andBroadcastingServiceLicences andSpectrumUseLicences aspublished in Government GazeteNo.4946,General NoticeNo.121 dated 20March 2012.

  4. When considering the award of a spectrum use licence,the Authority must consider the availability ofspectrum as appliedfor.

  5. In compliance with Section 101 of the Act and theRegulations regarding Licensing Procedures,the applicationwasfor2x20MHzFDDinthe 2.6 GHzspectrumbandfor the implementation of LTE services.Following due processin terms ofregulation11 of the Regulations regardingLicensing Procedures,the Authority published a notice in respect oftheapplicationinGovernmentGazetteNo.4756,GeneralNoticeNo217,dated15July 2011.The publication allowed for fourteen (14) days for public comments from the date of publicationof theNoticeinthe Gazette.Nopubliccommentswerereceivedandsubsequently noreplycommentswererequiredfromMobileTelecommunicationsLimited.

  6. Notall technicaldocumentsthatarerequiredbysection Gofthespectrumuselicense applicationformwassubmittedwith the applicationform.TheAuthority could therefore, notproceedwiththeevaluationoftheapplication.TheAuthorityformallyrequestedthe outstandingtechnicalinformationfromMobileTelecommunicationsLimitedinterms ofregulation6(4)oftheRegulationsregardingLicensingProcedures on8March2014. MobileTelecommunicationsLimitedsubmittedalloutstandingtechnicalinformationto theAuthorityon29April2014andthuscompliedwithallrequirementssetforthinthe applicationformfora spectrum use licence.Consequently theAuthority proceededwith the consideration and analysis of the application.

  7. TheAuthorityhasnotissued anynewspectrumuselicencesinthe2.6GHzspectrumband sinceitsestablishmenton18May201l.Allspectrumuselicensesheldbylicenseesin thisbandhasoriginallybeenissuedbytheNamibianCommunicationsCommissionand subsequentlytransitionedbytheAuthorityintermsofSection135of theActandRegulations regardingTransitionalProceduresforTelecommunicationsandBroadcastingService LicencesandSpectrumUseLicences.Thetablebelow depicts the current assignment of spectrumuselicences in the2.6GHzspectrumband asfrom13September2012,whichis the date of completion of the transitioning process for spectrum use licences.Please note: Thecolumnheadingsindicate thevariousspectrumuselicenceholderswhilst thecoloured blocksindicatethespectrumassignmentsforeachlicenceholder.

Telecom wnralwes

  1. Thetableaboveshowsthattheaforementionedspectrumbandhasbeenfullyassignedto existinglicenseesasreflectedinthetableandassuch,thereisnoavailablespectruminthe saidband to assigntolicensees at thisstage.
  2. Therefore,theAuthorityis unabletoawardaspectrumuselicencefor2x20FDDspectrum inthe2.6GHzspectrumband as appliedforbyMobileTelecommunicationsLimited as theaforementionedspectrumbandisfullyassigned toexistinglicensees.TheAuthority isfurtherunabletodetermineafuturedatewhenspectrummaybecomeavailableasitis dependent on thewithdrawal of spectrumuse licencesbythelicensees currently operating in the band orby theAuthority should a licenseenot complywith theRegulationsSetting Out ConditionsforSpectrumUseLicencesaspublished inGovernment GazetteNo.5354, NoticeNo.469dated2December2013afterfollowingdueregulatoryand administrative processes.
  3. In lightof theaboveandpursuanttotheprovisionofregulation11(9)oftheRegulations regardingLicensing Procedures,the Authority herewith declines the application for a spectrum use licence for 2x 20MHz FDD spectrum,in the 2.6GHZ spectrum band as submittedbyMobileTelecommunicationsLimitedinwhole.
